I spent the week with Bob Cheeley at the trial of one of the Georgia Southern nursing students who survived a wreck that took the lives of five nursing students. At trial, the truck driver provided no explanation of why he ran into two stopped cars full of 7 nursing students at a speed of 68 mph. About three years earlier, the truck driver totaled an 18-wheeler because he fell asleep. The jury awarded $15 million in compensatory damages and a settlement was reached before punitive damages were awarded, which undoubtedly would have been significant. But, in Georgia, punitive damages are capped at $250,000. Hard to call that punitive.
